Terms and Conditions — $mart (Web Beta)

These Terms are a contract between you and Bistec Group LLC ("we"), which operates the Beta version of $mart ("the Beta"). By pressing "Sign Up" or checking the acceptance box, or by using the Beta, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Beta.
1. Free and Experimental Beta
This is a free trial tool to organize your budget and understand how your money flows. It may have bugs, change, or become unavailable at any time.
2. Your Data Is Only Yours
Everything you enter (income, expenses, budgets) is stored only in your browser, encrypted, except encrypted backups you choose to export. We do not have access to that information. To use the Beta you need an account with your email address, verified with a code we email to you.
3. Not Financial Advice
This is personal organization only. It is not financial, tax, or legal advice. It does not connect to real banks or move money. Everything is based on what you enter manually. You alone are responsible for your financial decisions.
4. If You Clear Your Browser, Everything Is Deleted
If you clear your browser data, switch devices, or switch browsers, your data is permanently lost. To keep it, export a copy from Settings → Data & backup → Export data.
5. Acceptable Use
Do not use the Beta for illegal purposes; do not attempt to access others' accounts, overload, breach or automate the service, or use it to send emails to third parties. To the extent permitted by law, you will be responsible for damages you cause Bistec Group LLC by breaching these Terms.
6. Intellectual Property
$mart, including its software, source and object code, programming, architecture, design, interface, text and graphics, and the "$mart" brand and logos, is the exclusive property of Bistec Group LLC and is protected by the copyright, trademark and other intellectual property laws of Puerto Rico, the United States and international treaties. © 2026 Bistec Group LLC. Subject to these Terms, Bistec Group LLC grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Beta for personal, non-commercial purposes. No other rights are granted. You may not, without the prior written authorization of Bistec Group LLC, copy, modify, translate, distribute, sublicense, sell, create derivative works of, decompile, disassemble, reverse engineer, extract the source code of, circumvent technical measures of, or commercially exploit any part of the service, except to the extent applicable law expressly permits it notwithstanding this limitation.
The Beta includes third-party components (such as open-source libraries and fonts) that remain the property of their owners and are governed by their own licenses. The data you enter is yours. If you send us feedback or suggestions, Bistec Group LLC may use them freely, without any obligation to you. Unauthorized use may result in immediate termination of your access and appropriate legal action, including injunctive relief.
7. Warranties and Liability
The Beta is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Beta will be uninterrupted or error-free, or that calculations will be accurate. To the maximum extent permitted by law, Bistec Group LLC will not be liable for any indirect, incidental, special or consequential damages, or for loss of data, money or profits, arising from the use of or inability to use the Beta. Because the Beta is free, our total liability to you will not exceed one hundred U.S. dollars (US$100). Nothing in these Terms limits rights you have under law that cannot be waived.
8. Minimum Age
The Beta is a tool for learning to manage personal finances, designed for people aged 13 and older. You must be at least 13 years old to use it. If you have not reached the age of majority (21 in Puerto Rico, or the age set by the law where you live), you must have the permission of a parent or guardian, who accepts these Terms on your behalf and is responsible for your use of the Beta. The Beta is not directed to children under 13 and we do not knowingly collect their data; if we learn that a child under 13 opened an account, we will delete it.
9. Changes, Suspension and Termination
We may modify these Terms. When their version changes, we will show it to you when you sign in and you must accept it to keep using the Beta. We may suspend or end your access if you breach these Terms, and we may end the Beta at any time; if we do, we will try to give you reasonable notice so you can export your data. You may stop using it at any time and delete your account from Settings → Account, or ask us to delete it.
10. Governing Law and General Provisions
These Terms are governed by the laws of the Commonwealth of Puerto Rico and, where applicable, U.S. federal law, without regard to conflict-of-laws rules. Any dispute will be submitted to the courts of Puerto Rico (Commonwealth or federal), unless the law gives you, as a consumer, the right to sue in the courts where you live. If any provision is held invalid, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between you and Bistec Group LLC regarding the Beta. These texts exist in Spanish and English; if the two versions differ, the version in the language in which you accepted these Terms prevails.
